Summary: Lieutenant Schmiemann was shot and killed when a man attempted to rob him as he left his home.

Lieutenant Schmiemann was leaving his house on his way to work when a male approached with firearm drawn and ordered Lieutenant Schmiemann to turn over this money. Lieutenant Schmiemann drew his weapon and identified himself as an officer. The suspect shot Lieutenant Schmiemann and fled. Lieutenant Schmiemann was able to return fire, and wounded the suspect. He was later arrested when he sought medical attention for his wound.

The suspect was charged with murder. At one point the DA got a court order to remove the bullet lodged in the suspect so it could be used as evidence, but that decision was overturned by the New York State Court of Appeals. Despite not being able to remove the bullet, the DA won a conviction, and the suspect was sentenced to 25 years to life. He is eligible for parole in November, 2012.

Lieutenant Schmiemann had served with the New York City Police Department for 21 years and was survived by his wife and five children. He was assigned to the Inspections Services.
